Terms and Conditions

TERMINOLOGY

  • Megapool or We: means Megapool Education. Megapool is a wholly owned subsidiary of Worldwide Equipment Limited.
  • Parent: means any person who has signed the Enrollment Form and/or who has accepted responsibility for a child’s attendance at Megapool’s programme.
  • Student: means the child named on the Enrollment Form and/or the child who attends programme.
  • Participant: means the person aged over 18 named on the Enrollment Form and/or the person aged over 18 who attends programme.
  • Enrollment Form: means the Enrollment Form (hard copy or Megapool’s online registration system) provided by Megapool for the purpose of booking a place for the Student in the programme.

In all cases, irrespective of whether the Parent/Participant completes the Enrollment Form, these Terms and Conditions will apply to the agreement between Megapool and the Parent/Participant.

ENROLLMENT

  • A completed set of enrollment includes a completed Enrollment Form and full payment.
  • Once the completed Enrollment Form and full fees have been received by Megapool, the Parent/Student/Participant is sent confirmation email.
  • Confirmation of the Student/Participant’s specific class enrollment is only confirmed upon the confirmation email is sent to the Parent/Student/Participant.
  • Enrollments are non-transferable and non-refundable.
  • Megapool reserves the right to reschedule or cancel the Student/Participant’s enrollment at any time due to the class size of less than a minimum of 8 students per class.
  • Megapool reserves the right to make changes to the programme of study, theme, and/or activities at any time and for such reasons as may be reasonable and appropriate to the effective delivery of services by Megapool, without providing prior notice for such arrangements.

PAYMENTS

  • Completed Enrollment Form together with full payment must be submitted on enrollment.
  • Payment Methods:
    • Bank ATM / Internet transfer — (HSBC and The Bank of East Asia. Bank details to be provided via email upon receiving the completed Enrollment Form.)
      You must enter the Student/Participant’s Full Name and Course Code in “Remark” in the transaction. Please send the image of the transaction receipt to Megapool Education via email finance@megapool.com.hk, stating the Student/Participant’s Full Name and Course Code in the email subject. The original transaction receipt has to be kept for verification purpose.
    • Cheque by post — Crossed cheque made payable to “Worldwide Equipment Limited”, and post to: Megapool Education, Unit 2607, 26/F, Westin Centre, 26 Hung To Road, Kwun Tong, Kowloon, Hong Kong. Postdated cheque is not accepted.
    • In person — Please submit cash or a crossed cheque to our centre during office hours (Monday to Friday 0900-1800, except public holiday). Please call Megapool office in advance. We do not accept HK$1,000 bank note.
    • Credit card —  All credit card payments must be made by the Parent/Participant online via the Megapool’s secure payment portal operated by PayPal. Any credit card details received by Megapool via email or fax will not be used for payment purposes and will be destroyed.
  • Megapool does not provide refunds of programme fees, except in the event that the Student/Participant’s application for enrollment is not accepted or programme applied is cancelled.

CANCELLATION

  • If the Parent/Participant needs to cancel the Student’s/his or her programme for any reason, he/she should inform Megapool in writing immediately. Cancellation takes effect from the date when Megapool receives this notification.
  • All payments made are non-refundable and non-transferable.

PROGRAMME ARRANGEMENT AND CANCELLATION

  • Megapool reserves the right to make any changes to the programme including class size, class time, theme, and training materials. This may be to the Student/Participant’s advantage or disadvantage.
  • Megapool does not offer any make-up classes or refunds for missed classes.
  • In the event of tutor absence, Megapool will notify the Parent/Student/Participant of any class rescheduling via phone or email. Other than rescheduling lesson due to illness, Megapool will provide 48 hours’ notice or will reschedule lesson. If lesson cannot be rescheduled, the missed lesson will be refunded.
  • In the event of inclement weather conditions, the Parent/Student/Participant should refer to the “Inclement Weather Arrangement” on Megapool’s website. The Parent/Student/Participant should also pay attention to the news and Hong Kong Observatory weather reports and exercise discretion in deciding whether or not to send the Student or attend to class.
  • For classes cancelled due to inclement weather conditions or unexpected public health warnings, Megapool will try to make accommodate the majority makeup classes with no guarantee.

CLASS RULES

  • The Student/Participant must be on time for class(es) according to the schedule.
  • The Student/Participant must turn his/her mobile to silent mode during class or activity.
  • Eating is not allowed during class or activity.
  • Any form of bullying or intimidating behaviour is completely forbidden.
  • The Student/Participant who does not obey the class rules or who repeatedly misbehave or do not follow the instructions of the tutor/staff or otherwise disrupt the smooth running of the class will be asked to leave the class immediately at his/her own expense, and no part of the programme fee will be refunded.
  • The Student/Participant must not bring valuable possessions to attend the programme. If the Student/Participant does bring a valuable item with him/her, the Student/Participant is responsible for the security and safe use of that item.
  • Megapool is not able to accept responsibility for any lost, stolen or damaged personal possessions brought to the programme by the Student/Participant.
  • The full cost of repairing any damage caused by the Student/Participant to venue property or equipment, or to the personal property of another student, will be charged to the Parent/Participant. The Parent/Participant agrees to make payment in full by cash.

HEALTH AND SAFETY

  • The Parent/Participant warrants that the Student or he/she is in good physical and mental health and is not attending the programme against the advice of any doctor or qualified healthcare professional. The Parent/Participant agrees to inform Megapool when completing the Enrollment Form if the Student or he/she suffers from any pre-existing medical condition, disability or allergy.
  • The Parent is responsible to arrange appropriate transportation or pick-up for the Student to and from the venue for holding the programme. Megapool does not require the Student/Participant to sign-out or notify us when he/she is leaving the venue.
  • The Parent/Participant is solely responsible for the safety of the Student/himself/herself before and after class.
  • In case of serious accident or the Student/Participant requires urgent medical attention, Megapool’s staff will send him/her to the nearest hospital for immediate care or if necessary, will telephone for an ambulance.
  • The Parent/Participant authorises Megapool to consent on his/her behalf (to the Student) receiving emergency medical treatment including blood transfusions, general anaesthetic and operations where certified by an appropriately qualified person as necessary for the Student/Participant’s welfare and if the Parent/Emergency Contact Person provided on the Enrollment Form cannot be contacted in time.

FORCE MAJEURE, LIABILITY, DISCLAIMER

  • Megapool has public liability insurance.
  • Any liability of Megapool to the Parent/Student/Participant, in respect of which Megapool has insurance cover, shall be limited to the amount of such cover and any such liability.
  • In respect of which Megapool does not have insurance cover shall be limited to the aggregate amount of fees paid in respect of the Student/Participant.
  • Megapool shall not be liable in the event that any service contracted becomes impossible to supply due to reasons beyond its control, such events include but not limited to fire, natural disaster, act of government, failure of suppliers or subcontractors, labour disputes, war, disease outbreak, or terrorist attack. Megapool will not be liable for loss, damage, or injury to persons or property howsoever caused, save where the liability is expressly imposed beyond exclusion by statute. These conditions do not affect your rights as defined by the consumer protection laws in Hong Kong.
  • If Megapool is prevented from or delayed in carrying out its obligations under this agreement by a Force Majeure Event, it shall immediately notify the Parent/Participant in writing and shall be excused from performing its obligations while the Force Majeure Event continues.
  • Megapool can take any fair and reasonable action it considers appropriate should a situation arise which is not covered by these Terms and Conditions.
  • In the event of dispute, Megapool reserves the rights to the final decision.

MARKETING

  • Megapool takes photographs or videos of the Students/Participants enjoying the class and activity, without asking further approval from the participants. Unless the Parent of the Student or the Participant writes to tell us this is not acceptable, we may use these photographs or video clips in future Megapool promotional materials such as the flyer and website. The Parent/Participant wishing to opt out must do so by post to the Megapool office.
  • The Student/Participant/Parent would be asked to complete an evaluation form at the end of the class. Unless the Parent/Participant writes to tell us this is not acceptable, we may use any comments in future Megapool promotional material
  • Megapool reserves the right to change the price and offer promotions at any time to respond to market.

DATA PROTECTION

  • By agreeing to be bound by these Terms and Conditions, the Parent (on behalf of themselves and so far as they are able, on behalf of the Student) or the Participant, authorizes Megapool to process personal information as is deemed necessary for the legitimate purposes of Megapool.
  • The collection of personal data will be used for the above mentioned purpose and our direct marketing activities including but not limited to the promotion of our events, updates of information and services provided by Megapool. If The Parent/Student/Participant does not wish to receive our promotional materials or updates, would like to have a copy of the information Megapool holds about The Parent/Student/Participant, or have inaccurate personal data rectified or erased, please contact Megapool.

OTHERS

  • The Parent/Student/Participant is not permitted to solicit or make private arrangements for class or tuition with tutors employed by Megapool.
